Welcome to The Feelings Room. These Terms of Service ("Terms") govern your access to and use of thefeelingsroom.com (the "Site") and any products, books, curriculum, digital downloads, services, and content offered through the Site (collectively, the "Services"). The Site is operated by The Feelings Room ("we," "us," or "our"). By using the Site or purchasing from us, you agree to these Terms.

If you do not agree to these Terms, please do not use the Site or purchase from us.

1. Eligibility

The Site is intended for adults age 18 and older. Children and minors may enjoy our books and curriculum, but only an adult (parent, caregiver, educator, school, or district representative) may make purchases, create accounts, or enter into agreements with us.

By purchasing from us, you confirm that you are at least 18 years old and have the legal authority to enter into this agreement, including on behalf of any school, classroom, or district you represent.

2. Our Products and Services

The Feelings Room creates and sells belonging centered products for Black and Brown children, including but not limited to:

Physical children's picture books (print)
Digital downloads (worksheets, coloring pages, curriculum samples)
Full curriculum licenses (classroom, school, district)
Companion products and educational materials
Free resources offered in exchange for an email opt-in

We reserve the right to modify, discontinue, or restock any product at any time, with or without notice.

3. Pre-Orders

Some books and products are offered for pre-order before their official release date.

By placing a pre-order, you agree that:

Your payment method will be charged at the time of pre-order, not at the time of shipment.
The estimated ship date shown on the product page is our best estimate, and may shift due to printing, supply chain, or production timelines beyond our control.
We will email you to confirm your pre-order and again when your order ships.
You may cancel your pre-order at any time before it ships by emailing hello@thefeelingsroom.com. We will issue a full refund to your original payment method within 10 business days of receiving your cancellation request.
Once your pre-order has shipped, the standard refund policy (Section 5) applies.

4. Pricing, Payment, and Taxes

All prices are listed in U.S. dollars (USD). We accept payment through the payment processors enabled on the Site (currently Wix Payments, Stripe, and PayPal, subject to change).

You agree to pay all charges incurred by you or anyone using an account registered to you, at the prices in effect when the charges are incurred. You are responsible for any applicable sales tax, shipping fees, and customs/duties.

We reserve the right to correct any pricing errors on the Site, even after an order has been placed. If a corrected price is higher than what you were charged, we will contact you and give you the option to confirm the new price or receive a full refund.

5. Shipping, Returns, and Refunds

Shipping (physical books):
We ship within the United States. International shipping may be offered on a case-by-case basis. Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for shipping delays caused by carriers, customs, or events outside our control.

Returns and refunds — physical books:
We accept returns of unopened, unused physical books within 14 days of delivery. To request a return, email hello@thefeelingsroom.com with your order number. Return shipping costs are the responsibility of the buyer unless the book arrived damaged or defective. Once we receive and inspect the returned book, we will issue a refund to your original payment method within 10 business days.

Damaged or defective books: If a book arrives damaged or defective, email hello@thefeelingsroom.com within 7 days of delivery with photos. We will replace it at no cost to you or issue a full refund.

Digital downloads, worksheets, coloring pages, and curriculum:
Due to the nature of digital products, all digital downloads and curriculum purchases are final and non-refundable once accessed or downloaded. We will, however, make every reasonable effort to resolve issues if a digital file is corrupted, incomplete, or inaccessible. Email hello@thefeelingsroom.com.

School and district licenses:
Curriculum licenses purchased for classroom, school, or district use are non-refundable once delivered, but we will work with you in good faith to address any issues. Contact us before purchase if you have questions about fit.

6. License to Use Our Products

Physical books: When you buy a physical book, you own that copy. You may read it, share it within your household or classroom, and use it as a normal book. You may not reproduce, copy, scan, or distribute the contents.

Digital downloads (worksheets, coloring pages, free resources):

You may print and use the file for your own family, classroom, or counseling caseload.
You may not resell, redistribute, share online, upload to file-sharing sites, or claim authorship of any digital file you download from us.
You may not use our digital files in paid products, paid services, or paid courses without a separate written license from us.

Curriculum (classroom, school, and district licenses):

Single Classroom License: Use with one teacher, one classroom, one school year.
School License: Use across all classrooms in one named school site, one school year, renewable.
District License: Use across all school sites in one named district, one school year, renewable.
All licenses are non-transferable and may not be shared with other schools, districts, or organizations without our written permission.
Renewal terms and pricing will be communicated at least 60 days before the end of each license period.

Violation of these license terms may result in immediate license termination and legal action.

7. Intellectual Property

All content on the Site and in our products — including but not limited to text, illustrations, characters (Zara, Zion, Mrs. J, Mr. J, and any other characters), the 8-color feelings system, the bilingual mantras, curriculum materials, photographs, logos, brand names, and design — is owned by The Feelings Room and is protected by United States and international copyright, trademark, and other intellectual property laws.

"The Feelings Room," "The Melanated Social Justice School Counselor," "Real Feelings. Real Growth. Real You.," and related taglines are trademarks of The Feelings Room (registered or pending).

You may not copy, reproduce, modify, create derivative works of, publicly display, publicly perform, republish, download, store, distribute, or sell any content from the Site or our products without our prior written permission.

Fair use for review, criticism, and educational quotation is permitted under U.S. copyright law.

8. User Conduct

You agree NOT to use the Site or our products to:

Violate any applicable law or regulation
Infringe on our or anyone else's intellectual property
Harass, harm, threaten, or impersonate any person, including children
Transmit any virus, malware, or harmful code
Attempt to gain unauthorized access to the Site, our systems, or any account
Use automated systems (bots, scrapers, crawlers) to access the Site beyond reasonable browsing
Resell, reverse engineer, or republish our content
Misrepresent yourself or your affiliation in order to obtain school or district pricing

We reserve the right to refuse service, cancel orders, or block access to anyone who violates these Terms.

9. Email Communications and Marketing

When you sign up for a free resource, place an order, or otherwise provide your email address, you agree that we may send you:

Order and shipping confirmations
Pre-order updates
The free resources you requested
Marketing emails about new books, curriculum, free resources, and school partnership opportunities

You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link at the bottom of any email. Transactional emails (order confirmations, shipping updates, license renewals) will continue regardless of marketing preferences.

10. Third-Party Links and Services

The Site may contain links to third-party websites, services, or platforms (such as Teachers Pay Teachers, TikTok, Instagram, and our payment processors). We are not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of those services is governed by their own terms and policies.

11. Disclaimers

The Feelings Room provides belonging centered content created by a credentialed school counselor with over 12 years of experience in K-12 schools.

Our content is educational and not medical or therapeutic advice. Our books and curriculum are not a substitute for diagnosis, treatment, or care from a licensed mental health professional, therapist, psychiatrist, or physician. If a child is in crisis, please contact a qualified professional or, in an emergency, dial 911 or the 988 Suicide & Crisis Lifeline.

The Site and our products are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by law, The Feelings Room, its founder, its representatives, and its contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to loss of profits, data, use, goodwill, or other intangible losses — arising out of or related to your use of the Site, our products, or these Terms.

Our total liability to you for any claim arising out of these Terms or your use of the Services will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

Some states do not allow the limitation or exclusion of certain damages, so portions of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless The Feelings Room, its founder, its representatives, and its contractors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of:

Your use of the Site or our products
Your violation of these Terms
Your violation of any third-party right, including intellectual property or privacy rights
Any misrepresentation made by you

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles.

You agree that any dispute arising out of these Terms or your use of the Services will be resolved as follows:

Step 1 — Informal resolution: You agree to first contact us at hello@thefeelingsroom.com and give us 30 days to resolve the issue in good faith.

Step 2 — Binding arbitration: If the dispute cannot be resolved informally, you agree it will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Los Angeles County, California, or by remote/video hearing.

Class action waiver: You agree that any dispute will be resolved on an individual basis only, and not as a class, collective, or representative action.

This section does not prevent either party from seeking injunctive or equitable relief in court for intellectual property infringement.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through the Site or by email to active customers and subscribers.

Your continued use of the Site or purchase of our products after changes take effect means you accept the updated Terms.

16. Termination

We may suspend or terminate your access to the Site, your account, or any license at any time, with or without notice, if you violate these Terms or for any other reason at our reasonable discretion.

Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and these Terms generally) will survive termination of your account or these Terms.
